Online Ordering Terms & Conditions
1. General
By placing an order online, you agree to these Terms & Conditions and our full Terms of Trade available on our website.
2. Orders & Acceptance
All orders are subject to acceptance and availability. Martins Building & Landscape Supplies reserves the right to accept, reject or cancel any order. Orders may be adjusted if products are unavailable or quantities need to be amended.
3. Pricing
All prices are subject to change without notice. Prices may include or exclude delivery, surcharges or fuel levies unless stated. Errors or omissions in pricing may be corrected at any time.
4. Payment
Payment must be made in full prior to dispatch unless the customer has an approved account. Accepted payment methods include Direct Deposit and Credit Card (Visa, Mastercard, Amex). Merchant fees may apply to card payments.
5. Delivery
Delivery will be made to the nearest safe access point as determined by the driver. If access requires vehicles to enter private property, the customer accepts all associated risks. Delivery times are estimates only and may vary due to operational or site conditions. A reasonable unloading time is included. Additional charges may apply for delays.
6. Fuel Levy
A fuel levy may apply to deliveries and may vary without notice in line with supplier increases and fuel cost movements.
7. Product Information
Product images and descriptions are for guidance only. Variations in colour, size, and composition may occur, particularly with natural and bulk materials.
8. Returns & Refunds
Returns must be authorised within 7 days and accompanied by proof of purchase. Goods must be unused and in saleable condition. Special orders, bulk materials, custom products and delivery charges are non-returnable. Refunds will be issued to the original payment method only.
9. Cement Products
Cement products are moisture sensitive and must be stored in dry conditions. Cement products are non-returnable once collected or delivered.
10. Bulk Materials
Bulk materials are non-returnable once delivered or tipped.
11. Pallets
Pallet deposits apply where charged and will be credited upon return of pallets in good condition. No credit will be issued for damaged or unreturned pallets. Pallets remain the responsibility of the purchaser and must be stored safely and returned in good condition. Pallets must be returned within 30 days to be eligible for credit.
12. Risk & Liability
Risk in goods passes to the customer upon delivery or collection. Martins Building & Landscape Supplies is not responsible for damage arising from site conditions, access, or customer instructions.
13. Retention of Title
Goods remain the property of Martins Building & Landscape Supplies Pty Ltd until payment in full has been received.
14. Australian Consumer Law
Nothing in these terms excludes or limits rights under Australian Consumer Law.
15. Undeliverable Goods:
If delivery cannot be completed due to site access issues, unsafe conditions, incorrect delivery details, or customer unavailability, goods will be returned to the yard and a return to yard fee and additional delivery charges will apply.
